If you go out on Workman Comp can your employer cancel your health insurance?

My ex was off on workman comp for several months. While he was off his employer cancelled his and our kids health insurance, and told him he could do Cobra. They are also telling him he can not get his insurance restarted back until the next enrollment period after he comes back to work which is almost a year away. This does not sound right to me.

It's not up to the employer - it's IRS regulations. Yes. If they aren't actively on the payroll, they MUST be dropped from the group insurance, and offered COBRA. HOWEVER, I think they're wrong about not restarting you again until open enrollment - starting back up again is a qualifying event.

"Starting January 1, 2014 2014 Individual and Employer Requirements- Require U.S. citizens and legal residents to have qualifying health coverage" So now that we have to carry health insurance or else face a fee of $695 what would happen if I refuse to buy it. It can take the insurance company up to eight weeks to process it in the computer, or find out about it through your parents, HOWEVER, when it gets processed/discovered, the cancellation goes retroactively back to the day of the marriage. I dont understand the things though. $300/month for 2 is a bargain..check benefits closely deductible is paid as you see dr...ie; $500.00 deductible means the first $500 of care comes out of your pocket before the insurance pays anything. You may have a co-pay after that. You may have an amount to pay $20, $30, etc at each office visit after you pay your deductible...or...your dr bill is say $200.00 (and you have already paid deductible on other visits) your insurance may pay a percentage, say 80% ($160) and you pay 20% ($40). each plan is a little different. It's not the same. Car insurance is only required if you drive. You can choose alternative modes of transportation and thus avoid having to purchase auto insurance. You can't be forced to buy insurance just because you're alive.

First off, you mention that your husband is on "MediCare" = this is an important fact, and one that excludes you from purchasing a traditional health plan. You are limited to two types: 1. Medicare Supplemental plan (as medicare will from now on be your primary, they will handle all claims- a supplemental will handle excess charges -DEPENDING ON POLICY- by medicare in what is referred to as "cross-over". 2. HMO Assignment- depending on where you live in America, a HMO plan may or may not be available. I would suggest you call a "Medicare Health Insurance agency" in your area, who will be able to discuss your options with you, if you are in Southern California I can help you.

I'm sorry to say, that since the pregnancy is pre-existing, her chances are about zero of finding health insurance to cover her expenses. Delivering a child in a US hospital is very expensive; $5,000 for a normal birth and anywhere from $10,000 to $20,000 if there are complications. Her best bet would be to find a certified midwife to help her. Good luck.
